Statement from DEP Regarding Ruling by 11th Circuit Court of Appeal Upholding FDEP’s Adopted Numeric Nutrient Criteria

TALLAHASSEE – “This week, the 11th Circuit Court of Appeal upheld the U.S. EPA’s motion to discontinue federal rulemaking and allow the Florida Department of Environmental Protection to implement its adopted numeric nutrient criteria standards.  This ruling likely ends legal attempts to delay and overturn these EPA approved water quality standards designed to prevent algal blooms and other nuisance conditions in our treasured waterways.”

“Thanks to this ruling, Florida will have the most comprehensive numeric nutrient criteria in the nation. These comprehensive criteria serve to better protect Florida’s rivers, streams, lakes, springs, estuaries, and coastal waters. No other State in the nation has accomplished this level of protection against nutrient pollution.”

“This marks a significant step forward in protecting and restoring water quality across Florida.”
